Gridlock is not a modern legislative condition. Although the term is said to have entered the American political lexicon after the 1980 elections, Alexander Hamilton complained about it more than two hundred years ago. In many ways, stalemate seems endemic to American politics. Constitutional skeptics even suggest that the framers intentionally designed the Constitution to guarantee gridlock. In Stalemate, Sarah Binder examines the causes and consequences of gridlock, focusing on the ability of Congress to broach and secure policy compromise on significant national issues. Reviewing more than fifty years of legislative history, Binder measures the frequency of deadlock during that time and offers concrete advice for policymakers interested in improving the institutional capacity of Congress. Binder begins by revisiting the notion of "framers' intent," investigating whether gridlock was the preferred outcome of those who designed the American system of separated powers. Her research suggests that frequent policy gridlock might instead be an unintended consequence of constitutional design. Next, she explores the ways in which elections and institutions together shape the capacity of Congress and the president to make public law. She examines two facets of its institutional evolution: the emergence of the Senate as a coequal legislative partner of the House and the insertion of political parties into a legislative arena originally devoid of parties. Finally, she offers a new empirical approach for testing accounts of policy stalemate during the decades since World War II. These measurements reveal patterns in legislative performance during the second half of the twentieth century, showing the frequency of policy deadlock and the legislative stages at which it has most often emerged in the postwar period. Binder uses the new measure of stalemate to explain empirical patterns in the frequency of gridlock. The results weave together the effects of institutions and elections and place in perspective the impact of divided government on legislative performance. The conclusion addresses the consequences of legislative stalemate, assessing whether and to what degree deadlock might affect electoral fortunes, political ambitions, and institutional reputations of legislators and presidents. The results suggest that recurring episodes of stalemate pose a dilemma for legislators and others who care about the institutional standing and capacity of Congress. Binder encourages scholars, political observers, and lawmakers to consider modest reforms that could have strong and salutary effects on the institutional standing and legitimacy of Congress and the president.

About the Author

Sarah Binder is a senior fellow in Governance Studies at the Brookings Institution and an associate professor of political science at George Washington University. Her previous books include Minority Rights, Majority Rule: Partisanship and the Development of Congress (Cambridge University Press, 1997) and (with Steven S. Smith) Politics or Principle: Filibustering in the United States Senate, (Brookings, 1997).

This book was required for a graduate political science class and overall I enjoyed it. Binder starts with the sources of gridlock. Gridlock is rooted in the Constitution, but Binder believes it was an "unintended consequence" of the framers. Next she attempts to measure gridlock in past Congresses. For anyone writing a critical review, her methods here to determine salient issues are a great part to discuss. She finds that gridlock is more frequent during divided government. For those writing papers, David Mayhew's Divided We Govern is great to compare with Stalemate. Binder ends the book with suggestions for reducing gridlock, but these ideas don't add much. I actually met Dr. Binder, and she said she only put the suggestions in there at the request of her publisher.

Overall, it's a pretty good book and a rather easy read. Anyone interested in research methods will appreciate how Binder measures gridlock. If you're writing a paper or a critical review, there's a lot to take away from this book.

Jeffrey Rosen is a professor of law at the George Washington University Law School, the legal affairs editor of The New Republic, and a nonresident senior fellow at Brookings. His books include The Unwanted Gaze, The Naked Crowd, and The Supreme Court.

Speculation on future of Fourth Amendment law

This contains a very informative series of articles speculating on the future of technology implications for constitutional law in the areas of IT, surveillance, genetics, and neurology. I think change will be slower than Rosen desires, a good thing. The epilogue by Lawrence Lessig points out that the future is difficult to define, emphasizing the speculative nature of the book. Privacy and individual personality are hard concepts to define so that legislation has so far been dependent on speculative and bad sociology.

Highly Readable.......Can't put it down

This edited volume brings together a team of authorities in Con Law that create thoughtful dilemmas most of us may encounter. Recommended to me by a University of Virginia adjunct Law Professor with 20yrs experience practicing before the 4th Circuit, I can say this volume is spot on in information and scholarly discourse. Packed with information, this is a book you'll want to highlight and underline for future reference. This is a 21st Century must read.

Everyone needs to be aware of the complete loss of privacy. Many fail to consider a horrendous (not horrific, because something can't be horrible and also terrific--they cancel each other out) crime and organic impairment as a cause--leaving the attacker without control or recourse. Functional Magnetic Resonance Imaging (fMRI) brain scans provide a complete investigation. Here neuro-law evidence will transform the legal system and negate notions of moral responsibility.

The 4th Amendment dilemma, historically covering physical searches, must also include virtual searches. However, the Supreme Court has yet to understand and appreciate this. While the law needs to regulate widespread collection of data, greater attention must be applied to use and disclosure with emphasis not only on how but what to regulate. Kerr mentions that future surveillance must include future use restrictions on what can be done with information collected. All of us are aware of the computer cop "13yo girl"--bald, beer gut, sagging tits, hairy legs that no woman would want to see in shorts--preying on and entrapping the low IQ, lonely loser, and one who takes your tax dollars for more jails, more punishment, while depriving you of good roads, safe bridges, and an educational system that attempts to educate. We, as a society, must demand a victim before prosecution and return entrapment to its original meaning. I recall recently in a Federal Ledger class in which I advised a fellow student that we're now operating under a notion that it isn't entrapment if you appeared to have intentions of committing the act. We must STOP prosecuting and jailing solely on the basis of THOUGHT crimes. In order to do this we must nullify those "businesses" that survive solely on fear, hate, and group hysteria. Here lies a fault of the book. The Editors should have included significant mention of entrapment. Not in the index. Not in the book.

Goldsmith reminds of no Constitutional restrictions on military activity in the US, excepting the 3rd Amendment, and has a valuable inclusion of the Posse Comitatus Act and how the National Security Agency is exempt from this due to Congress enacting many exceptions.
Rosen applies Justice Kennedy's "autonomy of self" preventing the state's "dominant presence" as also applicable to ubiquitous surveillance which otherwise would prevent citizen defense and expression of individual liberties. We saw this grave concern in Homeland Security's deployment of naked body scanners without an NPRM--something unheard in Federal government, and the later backlash and change.
Wu, on speech architecture, provides significant commentary on censorial pressures from others by those often lacking a censorial instinct. But those looking for any discussion of FCC's jurisdiction will be sorely disappointed, as Wu caves to the nuances of private discrimination as a central place in regulating communications. I don't agree with this and I think many of you won't agree either.

Physicians will enjoy Morse's chapter on Neuroscience. Morse cites a case involving neurophysiological frontal cortex activity associated with poor behavioral regulation. Severe abuse history combines with a genetic enzyme abnormality affecting specific neurotransmitter levels, producing marked antisocial behavior. How is just punishment conveyed to victims of neuronal circumstances wherein no one is actually responsible? While Morse attempts to make a case for preventive civil detention and involuntary treatment in cases of impaired rationality, his notion of "desert-disease jurisprudence" is lacking. We must reach a consensus on "dangerous proclivities" and individual responsibility that is not solely governed by emotion and hysteria. Then, who is to decide? One more argument against Capital Punishment and the blood thirsty who would impose this at any cost to actual innocence of having committed the crime. Morse's unique view of criminal law imposes a "folk psychology" of person and behavior, using mental states as fundamental to "full causal explanation." Morse cites the difficulty in defining "loss of control" as one reason it becomes difficult to conceptualize cases involving internal compulsive states, taking the reader to "disorders of desire" (drugs/sex). More on brain regions and neurotransmitters appeared in the NY Times "The Voices in My Head Say `Buy It!' Why Argue?"

Snead makes a convincing case for prefrontal cortex diminished activity (reasoning, self-restraint, long-term planning) and greater than normal limbic activity (more primitive fear/aggression) with neuroanatomical structural abnormalities consistent with psychopathic behavior. Snead (p136) presents a case offering convincing evidence with a prefrontal cortex concussive injury preventing the father from restraining impulses to molest his 5yo daughter, and another case of a teacher with an egg-sized prefrontal lobe tumor who had no criminal record and a stable marriage, who could not restrain himself from viewing child pornography, soliciting sex, and making sexual overtures to his stepdaughter. After tumor removal, these behaviors stopped. Snead's attack on the cognitive neuroscience project and its threat to enlarge the "disease" justification obfuscates the fact that there is no behavior that cannot be changed. Period. Those opting for extended detention including some so-called "licensed professionals(?)" don't want you to believe this. Where was their training in aversive conditioning? Probably stuck and forever lost in a cognitive-behavioral nether zone.

Also covered are electronic artificial intelligence, Cohen and Rowe calling Roe v. Wade "a dubious decision" but thoughtfully adding "in our judgment" (Avoid Chapter 11), and Robertson's preimplantation genetic diagnosis as opposing a notion of children as "gifts." Readers will find entertaining Boyle's take on genetic engineering-- taking the reader to the ethereal zone of sex dolls (½ human, ½ worm=sexy 20yo blonde with consciousness of a roundworm and no brainstem activity who only wriggles when you touch her) and more realistic debate on corporate personhood. Wittes' commentary on the natural occurrence of deadly pathogens, and misuse of technologies, biosecurity problems takes the reader to Wittes support of government leveraging/monitoring gene synthesis equipment (companies/scientists) although he admits unlicensed people who want to build bugs will do so. Lessig thoughtfully invokes that constitutional interpretation comes from what everyone knows is true as from what the framers wrote--a living, working, viable document (Are you listening, Justice Scalia?)

A Must read for all U.S. citizens

This series of essays discuss current and future technologies and how they might interact with the Constitution and laws, both state and federal. Some are current news, like law enforcement installing GPS tracking devices on cars without a warrant, and many are probable future issues.

Issues like cloning of humans, genetic engineering/tampering for gender selection or trait selection (like hair color, sexual orientation, physical abilities, or elimination/reduction of genetic diseases) and what it means to be human and have the rights associated with being human.

In many of the essays an author position can be gleaned but all of them make a good effort to present both sides of each issue, the possible social ramifications and concerns, and legal aspects of each topic.

The myriad of reform documents and policy discussions that have appeared over the past decade have not helped to pinpoint exactly what should be done.

The case for investment in education is an economic one: schooling improves the productivity and earnings of individuals and promotes stronger economic growth and better functioning of society. Recent trends in schooling have, however, lessened the value of society's investments as costs have risen dramatically while student performance has stayed flat or even fallen. The task is to improve performance while controlling costs.

This book is the culmination of extensive discussions among a panel of economists led by Eric Hanushek. They conclude that economic considerations have been entirely absent from the development of educational policies and that economic reality is sorely needed in discussions of new policies. The book outlines an improvement plan that emphasizes changing incentives in schools and gathering information about effective approaches. Available research and analysis demonstrates that current central decisionmaking has worked poorly. Concentrating on inputs such as pupil-teacher ratios or teacher graduate degrees appears quite inferior to systems that directly reward performance. Nonetheless, since experience with such alternatives is very limited, a program of extensive evaluation appears to be in order.

Attempts to institute radical change on the basis of currently available information involve substantial risks of failure. Many people today find proposals such as charter schools, expanded use of merit pay, or educational vouchers to be appealing. Yet there is little evidence of their effectiveness, and widespread adoption of these proposals is sure to run into substantial problems of implementation. Instead of choosing the "right" approach, this book advocates a more systematic approach of experimentation, evaluation, and change.

On April 11, 1981, two neighboring Palestinian Arab towns competed in a soccer match. Kafr Yassif had a predominantly Christian population, and Julis was a predominantly Druze town. When a fight broke out between fans, the violence quickly escalated, leaving a teenager from each town dead. In the days that followed the game, a group from Julis retaliated with attacks on the residents of Kafr Yassif. Shihade experienced that soccer match and the ensuing violence firsthand, leaving him plagued by questions about why the Israeli authorities did not do more to stop the violence and what led to the conflict between these two neighboring Arab towns.

Drawing on interviews, council archives, and media reports, Shihade explores the incident and subsequent attack on Kafr Yassif in the context of prevailing theories of ethnic and communal conflict. He also discusses the policies of the Israeli state toward its Arab citizens. Countering Orientalist emphases on Arab and Islamic cultures as inherently unruly and sectarian, Shihade challenges existing theories of communal violence, highlighting the significance of colonialism’s legacy, modernity, and state structures. In addition, he breaks new ground by documenting and analyzing the use of a traditional Arab conflict resolution method, sulha, which has received little sustained attention from scholars in the West.

Shihade opens the toolkits of anthropology, history, political science, and studies of ethnic and communal conflict with the goals of exposing the impact of state policies on minority groups and encouraging humane remedial principles regarding states and society.

Ben Klemens is a guest scholar at the Center on Social and Economic Dynamics at the Brookings Institution, where he writes programs to perform quantitative analyses and policy-oriented simulations. He also consults for the World Bank on intellectual property in the developing world and computer-based simulations of immigration policy.

An economist's flawed appeal to theoretical computer science concepts

Ben Klemens finds fault with the Federal Circuit's departure from longstanding doctrine that has regarded mathematical formulas as "abstract ideas" to be excluded from patentable subject matter. The central thesis of Klemens's book is that a claim to a programmed computer should be unpatentable whenever the program is the only innovative element, because every computer program is "nothing but a mathematical equation." Klemens, an economist by training, attempts to support this characterization by loosely paraphrasing a classical result in theoretical computer science, the Church-Turing Thesis, and stating -- without proof -- sweeping and conclusory propositions that supposedly follow as corollaries from Alonzo Church's and Alan Turing's intricate mathematical theories of recursive functions. The ultimate effect, if not the purpose, of Klemens's uninformed appeal to deep theory is to dazzle the "non-geeks" rather than to prove any point. The Church-Turing Thesis actually applies to relatively few software-related inventions and does not actually speak to Klemens's proposed doctrinal reforms.

a book you can use...

Klemens has a knack for bringing humour and spirit to a subject most people might be inclined to regard as dull (i.e., software patent policy) - as well as explaining why addressing that subject is crucial. His background as a trained economist and practicing computer programmer gives him inside understanding of both the theoretical policy debate as well as its practical impact on the work of coding. The book is an invaluable resource - and you'll love the banana protective device diagram.

Extremely informative, if a little inaccurate

I am a computer scientist and mathematician who decided to read this book based solely on the title. I really enjoyed it and learned a lot, but in some cases the book was dated and I learned from googling around to see the current state of affairs.

The good stuff: explaining the initial history of patent law for software in a clear and interesting way. Talking about the distinctions between patents, copyright, and DMCA rights. Giving accurate indications of how software is generated collaboratively and how it evolves. Talking about what sort of transformations to code are trivial (changing languages, renaming, reordering). Continuing a pretty good distinction between interface and implementation and framing most of the legality around that.

The bad stuff: reducing all algorithms to math. As indicated in the title, the starting reasoning is that programs = math, and math can't be patented. But the = is a misleading over-simplification, in the sense that real devices are constantly interacting with users and hardware. Even comparing a Turing machine to a simple RAM device with no IO, there's a huge practical difference in running time between using a tape and using random access memory... and patents are mostly about practicality. Also, FPGAs seemed to be described inaccurately.

Badly hidden agenda: abolishing all software patents. In some places you may want to skip a paragraph or two of single-minded argumentation towards this goal.

Bottom line: This book makes me appreciate more of the news on patents. If you know lots of math/programming theory but not the business side, I highly recommend this book.

PS: Ben always talks about "programmers in the basement" of every company. Why do they all have to get basement offices? Who is working above-ground at Google?
